To assure the documents they prepared would be accepted in England, other colonies, and other countries, they followed a system developed in England for authenticating documents used in international commerce.<\/p>\n<p>The notary&#8217;s <strong>signature<\/strong> and <strong>seal<\/strong> on a document were valid evidence of its <strong>authenticity<\/strong> and assured its acceptance around the world.<\/p>\n<p>Most notarial records of this time period have been lost or destroyed, making the history of colonial notaries difficult to discover.<\/p>\n<p>Note: The Kingdom of England and the Kingdom of Scotland, and their flags, were joined in 1707 through the Act of Union, creating the United Kingdom of Great Britain. Starting in 1707, the term British is used rather than English. <strong>Britannia<\/strong> was the Latin name used for the province during the Roman Empire, named after a Roman goddess.<\/p>\n<p><!--more--><\/p>\n<h2><img decoding=\"async\"  class=\"size-medium wp-image-3861 alignleft\" src=\"data:image\/gif,GIF89a%01%00%01%00%80%00%00%00%00%00%FF%FF%FF%21%F9%04%01%00%00%00%00%2C%00%00%00%00%01%00%01%00%00%02%01D%00%3B\" data-layzr=\"https:\/\/abclegaldocs.com\/blog-Colorado-Notary\/wp-content\/uploads\/Jamestown-Virginia-English-Colonists-Landing-1607-e1597540358940-233x150.jpg\" alt=\"Jamestown Virginia English Colonists Landing 1607\" width=\"233\" height=\"150\" \/>First Colonies<\/h2>\n<p>There were attempted English colonies at <strong>Roanoke Island<\/strong>, North Carolina, 1587, (the Lost Colony), and little-known <strong>Popham<\/strong>, Maine, 1607, but they were not successful and had no notaries.<\/p>\n<p><strong>Jamestown<\/strong>, Virginia, 1607, [see image] initially struggled with disease, weather, and starvation before longer term settlement took hold.\u00a0 No information about notaries at Jamestown was found.<\/p>\n<p>In addition to the English colonies, several other European countries had notaries in their expeditions or colonies, before the <strong>American Revolution<\/strong>, including <span style=\"text-decoration: underline;\"><strong><a href=\"https:\/\/www.abclegaldocs.com\/blog-Colorado-Notary\/ulibarri-claims-colorado-for-spain-1706\/\" target=\"_blank\" rel=\"noopener\">Spain<\/a><\/strong><\/span>, <span style=\"text-decoration: underline;\"><strong><a href=\"https:\/\/www.abclegaldocs.com\/blog-Colorado-Notary\/la-salle-expedition-louisiana-territory-1682\/\" target=\"_blank\" rel=\"noopener\">France<\/a><\/strong><\/span>, <span style=\"text-decoration: underline;\"><strong><a href=\"https:\/\/www.abclegaldocs.com\/blog-Colorado-Notary\/new-sweden-colony-delaware-river-1638-1655\/\" target=\"_blank\" rel=\"noopener\">Sweden<\/a><\/strong><\/span>, and <span style=\"text-decoration: underline;\"><strong><a href=\"https:\/\/www.abclegaldocs.com\/blog-Colorado-Notary\/dutch-notaries-new-netherland\/\" target=\"_blank\" rel=\"noopener\">The Netherlands<\/a><\/strong><\/span>.<\/p>\n<p><img decoding=\"async\"  class=\"size-full wp-image-10081 alignleft\" src=\"data:image\/gif,GIF89a%01%00%01%00%80%00%00%00%00%00%FF%FF%FF%21%F9%04%01%00%00%00%00%2C%00%00%00%00%01%00%01%00%00%02%01D%00%3B\" data-layzr=\"https:\/\/abclegaldocs.com\/blog-Colorado-Notary\/wp-content\/uploads\/Pilgrims-landing-Plymouth-MA-1620.jpg\" alt=\"Pilgrims landing Plymouth MA 1620\" width=\"200\" height=\"150\" \/>The <strong>Pilgrims<\/strong> landed at <strong>Plymouth Rock<\/strong>, in the Plymouth Colony, in <strong>1620<\/strong> [see image].<\/p>\n<p>The first colonial notary was appointed in <strong>1639<\/strong>. Colonial notaries served until the adoption of the <span style=\"text-decoration: underline;\"><strong><a href=\"https:\/\/www.abclegaldocs.com\/blog-Colorado-Notary\/u-s-constitution-bill-of-rights\/\" target=\"_blank\" rel=\"noopener\">U.S. Constitution<\/a><\/strong><\/span> in 1789.<\/p>\n<p>&nbsp;<\/p>\n<h2><span class=\"ez-toc-section\" id=\"Scriveners_and_Colonial_Notaries\"><\/span>Scriveners and Colonial Notaries<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>At the time of colonial notaries arrival, the developing legal profession in England was mostly unregulated. Legal documents were prepared by <strong>scriveners<\/strong> and notaries. Scriveners were literate men who wrote private letters and legal instruments for clients. They were often school teachers or clergy with some knowledge of the law.<\/p>\n<p>Notaries were sworn <strong>public officials<\/strong>, appointed by the <strong>Archbishop of Canterbury<\/strong>, near London. They were registrars in <strong>ecclesiastic courts<\/strong>, dealing with marriage, divorce and testamentary matters, and in <strong>admiralty courts<\/strong>, dealing with <span style=\"text-decoration: underline;\"><strong><a href=\"https:\/\/www.abclegaldocs.com\/blog-Colorado-Notary\/marine-protest-maritime-law\/\" target=\"_blank\" rel=\"noopener\">maritime<\/a><\/strong><\/span> issues. These courts followed <span style=\"text-decoration: underline;\"><strong><a href=\"https:\/\/www.abclegaldocs.com\/blog-Colorado-Notary\/roman-law-influence-on-notaries\/\" target=\"_blank\" rel=\"noopener\">Roman civil law<\/a><\/strong><\/span> procedure.<\/p>\n<p>By the seventeenth century, notaries were split into <strong>ecclesiastical notaries<\/strong>, and <strong>secular notaries<\/strong> who dealt with commercial matters and foreign trade.<\/p>\n<p>Legal documents included bills of sale, bottomry bonds, bills of lading, charters, powers of attorney for merchants, <strong>protests<\/strong> of dishonored bills of exchange, and <strong>ship protests<\/strong> documenting damages to a ship or its cargo.<\/p>\n<p>Notarial acts were accepted with <strong>full faith and credit<\/strong> in all nations.<\/p>\n<h2><span class=\"ez-toc-section\" id=\"Timeline_of_Colonial_Notaries_in_the_Thirteen_Colonies\"><\/span>Timeline of Colonial Notaries in the Thirteen Colonies<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p><span style=\"background-color: #ffff00;\">1.\u00a0 <strong>Connecticut<\/strong>, 1639.<\/span> <strong>Thomas Fugill<\/strong> was appointed notary public in October 25, 1639 by the General Court in the Province of <strong>New Haven<\/strong>.\u00a0 He was the Secretary for the colony and the first notary in the English colonies.<\/p>\n<p>&#8220;<em>Tho. Fugill was chosen publique notary, to attend the court and from time to time to ke[ep] a faithful recorde of all passages and conclusions of the court, and of whatsoeu[er] else then or att other times shall by the court or magistrate be comitted to him concerning the ciuill publique occasions of the Plantation.<\/em>&#8221;<br \/>\nfrom Records of the Colony and Plantation of New Haven, from 1638 to 1649<\/p>\n<p>None of his notarial records have survived. Several years later, he was removed from office and excommunicated from the Church for dishonesty in land allotments. He returned to England and there is no further record of him.<\/p>\n<p>Connecticut did not develop a busy commercial trade or major port like Boston, so few notaries were needed.<\/p>\n<p><img decoding=\"async\"  class=\"size-full wp-image-10083 alignleft\" src=\"data:image\/gif,GIF89a%01%00%01%00%80%00%00%00%00%00%FF%FF%FF%21%F9%04%01%00%00%00%00%2C%00%00%00%00%01%00%01%00%00%02%01D%00%3B\" data-layzr=\"https:\/\/abclegaldocs.com\/blog-Colorado-Notary\/wp-content\/uploads\/Colonial-America-map.jpg\" alt=\"Colonial America map 13 colonies\" width=\"400\" height=\"300\" \/><span style=\"background-color: #ffff00;\">2.\u00a0 <strong>Massachusetts<\/strong>, 1644.<\/span> Merchants in England and the Massachusetts Bay Colony followed the practices based on the <strong>Law Merchant<\/strong>, an international body of law.<\/p>\n<p>The court ordered that <span style=\"text-decoration: underline;\"><strong><a href=\"https:\/\/www.abclegaldocs.com\/blog-Colorado-Notary\/law-merchant-pie-powder-courts\/\" target=\"_blank\" rel=\"noopener\">Les Mercatoria<\/a><\/strong><\/span>, 1622, written by merchant Gerard de Malynes, be studied and used as a legal reference.<\/p>\n<p>On November 13, 1644, <span style=\"text-decoration: underline;\"><strong><a href=\"https:\/\/www.abclegaldocs.com\/blog-Colorado-Notary\/aspinwall-notarial-records-boston-1644\/\" target=\"_blank\" rel=\"noopener\">William Aspinwall<\/a><\/strong><\/span> was appointed as Recorder and the first notary by the General Court.<\/p>\n<p>His notary journal for 1644 to 1651, with over 1200 entries, survived and was published as a valuable historic record in 1903. It is the only known book of 17th century notarial records from any of the English colonies. Entries include a wide variety of maritime and commercial matters.<\/p>\n<p>The notary&#8217;s oath of office required the notary to be true and sincere and keep a <strong>true record<\/strong> of all notarial matters.<\/p>\n<p>In 1650, the General Court passed an Act listing the fees and duties of notaries. In 1684, the court authorized a <strong>notary seal<\/strong>, but it appears it was never implemented.\u00a0 Personal seals, hand-written seals, and flourishes may have been used.<\/p>\n<p>It is not known how Aspinwall acquired notary knowledge. He may have studied a reference book or documents prepared by general notaries.<\/p>\n<p>In October 1651, Aspinwall was charged with jury tampering and one year later he was removed from notary office and succeeded by Nathaniel Souther.<\/p>\n<p><span style=\"background-color: #ffff00;\">3. <strong>Virginia<\/strong>, 1662.<\/span>\u00a0 The General Assembly appointed <strong>Henry Randolph<\/strong>, clerk of the assembly, as the first notary in March 1662.\u00a0 He was clerk of Henrico County from about 1656 and of the house of burgesses from 1660 to his death in 1672.<\/p>\n<p><span style=\"background-color: #ffff00;\">4. <strong>Rhode Island<\/strong>, 1663.<\/span>\u00a0 Rhode Island received its royal charter in 1663, and the General Assembly appointed the Colony Recorder in Newport as notary public. Notary fees were established in 1766.<\/p>\n<p><span style=\"background-color: #ffff00;\">5. <strong>Maryland<\/strong>, 1663.<\/span>\u00a0 The General Assembly appointed the Secretary of the Province as the first notary, authorized to affix the <strong>Lesser Seal<\/strong> of the Province to all attestations. The fee for an <strong>attestation<\/strong> was 50 pounds of <strong>tobacco<\/strong>, and 50 pounds for <strong>recording<\/strong>.<\/p>\n<p><span style=\"background-color: #ffff00;\">6. <strong>New York,<\/strong> 1664.<\/span>\u00a0 Following the surrender of the <strong>Dutch<\/strong> in <span style=\"text-decoration: underline;\"><strong><a href=\"https:\/\/www.abclegaldocs.com\/blog-Colorado-Notary\/dutch-notaries-new-netherland\/\" target=\"_blank\" rel=\"noopener\">New Netherland<\/a><\/strong><\/span> to the English in 1664, Governor Richard Nicolls appointed <strong>Thomas Carveth<\/strong> as the first English notary in New York (formerly New Amsterdam).<\/p>\n<p><span style=\"background-color: #ffff00;\">7. <strong>New Hampshire<\/strong>, 1690.<\/span>\u00a0 <strong>Thomas Brattle<\/strong> was appointed as the first notary by the Governor of Massachusetts, which also claimed jurisdiction over the Puritan colony at <strong>Portsmouth<\/strong> to expand its territory.<\/p>\n<p>It also appears that notaries were appointed by the <strong>Archbishop of Canterbury<\/strong> by 1679. A criminal statute prescribed penalties for a notary or keeper of public records who stole, falsified, defaced, or altered any record in his custody, under <strong>penalty<\/strong> of removal from office, disfranchisement, <strong>burning<\/strong> in the face, or fine.<\/p>\n<p>Notary fees were regulated in 1718.<\/p>\n<p><span style=\"background-color: #ffff00;\">8. <strong>Pennsylvania<\/strong>, 1701.<\/span>\u00a0 The first notary was appointed before 1701.<\/p>\n<p><span style=\"background-color: #ffff00;\">9. <strong>New Jersey<\/strong>, 1702.<\/span>\u00a0 The Royal Province of New Jersey was formed in 1702. The first notary is not known.<\/p>\n<p><span style=\"background-color: #ffff00;\">10. <strong>South Carolina<\/strong>, 1741.<\/span>\u00a0 <strong>William Whitside<\/strong>, from Georgetown, near Charleston, was appointed first notary in March.<\/p>\n<p><img decoding=\"async\"  class=\"size-medium wp-image-1468 alignleft\" src=\"data:image\/gif,GIF89a%01%00%01%00%80%00%00%00%00%00%FF%FF%FF%21%F9%04%01%00%00%00%00%2C%00%00%00%00%01%00%01%00%00%02%01D%00%3B\" data-layzr=\"https:\/\/abclegaldocs.com\/blog-Colorado-Notary\/wp-content\/uploads\/Declaration-of-Independence-signers-200x140-200x140.jpg\" alt=\"Declaration of Independence signers\" width=\"200\" height=\"140\" \/><span style=\"background-color: #ffff00;\">11. <strong>Delaware<\/strong>, 1765.<\/span>\u00a0 The Governor of Pennsylvania appointed <strong>Thomas McKean<\/strong> as notary in Delaware. Thomas McKean was one of the signers of the <span style=\"text-decoration: underline;\"><strong><a href=\"https:\/\/www.abclegaldocs.com\/blog-Colorado-Notary\/declaration-of-independence-1776\/\" target=\"_blank\" rel=\"noopener\">Declaration of Independence<\/a><\/strong><\/span> in 1776 [see image], Chief Justice of Pennsylvania (1777-1799), and Second Governor of Pennsylvania (1799-1808).<\/p>\n<p><span style=\"background-color: #ffff00;\">12. <strong>North Carolina<\/strong>, 1777.<\/span>\u00a0 The first notary was probably appointed shortly before this time.<\/p>\n<p><span style=\"background-color: #ffff00;\">13. <strong>Georgia<\/strong>, 1792.<\/span>\u00a0 Courts elected notaries and the legislature passed a statute regulating notary fees.<\/p>\n<h2><span class=\"ez-toc-section\" id=\"Colonial_Legal_Forms\"><\/span>Colonial Legal Forms<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>William West&#8217;s <span style=\"text-decoration: underline;\"><strong><a href=\"https:\/\/books.google.com\/books\/about\/The_First_Part_of_Symboleography_which_M.html?id=lMJjAAAAcAAJ\" target=\"_blank\" rel=\"noopener\">Symboleography<\/a><\/strong><\/span>, published in 1590, was the first major collection of legal forms, and the only book on notarial practice.\u00a0 Legal form books have been a part of English literature since the 12th century.<\/p>\n<p>Before the American Revolution, lawyers in the British Colonies relied on <strong>legal forms<\/strong> reprinted from English legal books, in publications including <strong>The Young Clerk&#8217;s Magazine<\/strong>, Philadelphia, 1774.\u00a0 To save time, rather than hand copy the forms printed in books, pre-printed legal forms were published, known as legal blanks, and sold by bookstores along with legal books.<\/p>\n<h2><span class=\"ez-toc-section\" id=\"US_Notaries_Today\"><\/span>U.S. Notaries Today<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>Since the <strong>U.S. Constitution<\/strong> does not mention notaries, each state has authority to write and administer notary laws as it chooses.\u00a0 Fundamental notarial acts are the same, but there are differences in notary qualifications, training, testing, bonding, record keeping, seals, duties, and powers.<\/p>\n<p>More states are adopting the <span style=\"text-decoration: underline;\"><strong><a href=\"https:\/\/www.abclegaldocs.com\/blog-Colorado-Notary\/rulona-revised-uniform-law-on-notarial-acts\/\" target=\"_blank\" rel=\"noopener\">Revised Uniform Law on Notarial Acts (RULONA)<\/a><\/strong><\/span>, bringing more uniformity to the nationwide notarial standards.<\/p>\n<p>More states are also adopting new laws to authorize <strong>Remote Online Notarization (RON)<\/strong> using live two-way video conferencing technology and electronic documents over the <strong>internet<\/strong>.<\/p>\n<p><strong>Louisiana<\/strong> notaries are trained civil law notaries since their laws originate in <strong>France<\/strong>, once part of the <strong>Roman Empire<\/strong>.<\/p>\n<p><strong>Image Credits<\/strong><br \/>\n1.
