\"apostille<\/a>Apostille or Authentication<\/h1>\n

Notarized documents that are going to a foreign country<\/strong> often require an apostille<\/strong> or authentication<\/strong> certificate.\u00a0 This provides additional security<\/strong> and validation<\/strong> of the notary stamp<\/strong>.<\/p>\n

To get an apostille in Colorado, the notary will notarize the document in a normal manner.\u00a0 Then, if the customer requires an apostille or authentication, the document must be mailed or delivered to the Colorado Secretary of State<\/strong> (SOS). \u00a0A paid\u00a0courier service<\/strong> could also be used if you need same-day service.<\/p>\n

[Note: during the pandemic<\/strong>, documents must be delivered to the SOS office by U.S. Mail only. Walk-in service is not available.]
\n<\/p>\n

<\/span>Request Form to SOS<\/span><\/h2>\n

The customer must fill out and submit an Apostilles and Authentications Request Form<\/a><\/strong><\/span>, follow the instructions, list the destination country<\/strong>, and pay a service fee to the SOS for the authentication.\u00a0 The SOS will look up the record for the notary who has stamped the document.<\/p>\n

The SOS will verify that the notary is in good standing<\/strong>, that the notary commission is not expired, and will verify the notary signature<\/strong> on the document matches the notary signature kept on file.\u00a0 The notary provides a signature on the notary application form.<\/p>\n

The SOS does not verify the contents of the document.\u00a0 If the notarization is done correctly, and the notary signature is valid, and the notary is in good standing, then the SOS will attach an authentication certificate<\/strong>, including the seal<\/strong> of the State of Colorado, and an authentication\u00a0number, to the document.<\/p>\n

Here is a Sample Colorado Apostille<\/a><\/strong><\/span>\u00a0from the Colorado SOS, for use in Argentina.<\/p>\n

<\/span>Apostille or Certificate of Magistracy<\/span><\/h2>\n

If the destination country has approved the Hague Convention<\/strong> of 1961, then the authentication used is a standardized certificate called an apostille<\/strong>, which is a French<\/strong> word.\u00a0 If the destination country has not approved the Hague Convention, then a notary\u00a0Certificate of Magistracy<\/strong>\u00a0is attached. For a list of participating countries, see Hague Convention members<\/a><\/strong><\/span>.<\/p>\n

After authentication, the SOS will mail the document back to the customer, or the customer may choose to pay an additional fee for expedited service<\/strong> to have the document authenticated while the customer waits.<\/p>\n

The notary may choose to offer apostille agent service for a fee to assist the customer in obtaining the apostille or authentication, or the customer may choose to do it.\u00a0 Some notaries around the country specialize in processing apostilles, authentications, and documents that require assistance from a foreign embassy<\/strong> or consulate<\/strong>.\u00a0 There are some foreign embassies and consulates in Denver and Boulder.<\/p>\n

<\/span>Common Law, Civil Law, Islamic Law Legal Systems<\/span><\/h2>\n

There are currently 193 member countries of the United Nations<\/strong>, with 87 members of the Hague Convention<\/strong>.\u00a0 Notary laws vary by country, based on the legal system used.<\/p>\n

The common law<\/a><\/strong><\/span> legal system is used in countries that are now or were previously controlled or colonized by the British Empire<\/strong>.\u00a0 Common law is used in the United States, except for Louisiana<\/a><\/strong><\/span> and Puerto Rico<\/a><\/strong><\/span>, which use civil law.<\/p>\n

The civil law<\/strong> legal system is used in countries that were previously controlled or colonized by the Roman Empire<\/a><\/strong><\/span>, the French Empire<\/strong> of Napoleon<\/strong>, or by Spain, Portugal, Italy, Netherlands, Denmark, Germany, or Belgium.<\/p>\n

The Islamic law<\/strong> legal system is based on the Quran<\/strong> and is used in countries that have a significant or majority Muslim<\/strong> population.<\/p>\n

Some countries use a legal system comprised of a mixture of common law, civil law, or Islamic law, and sometimes native or customary law.<\/p>\n

<\/span>County Clerk Authentication<\/span><\/h2>\n

In some states, the notary commission must be authenticated by the county clerk<\/strong> before going to the SOS. These states are Kentucky, Hawaii, Maryland, New York, and Tennessee.<\/p>\n

<\/span>U.S. State Department Authentication<\/span><\/h2>\n

For documents signed or notarized by a U.S. Federal Official,\u00a0an American Consular Officer,\u00a0a Military Notary<\/strong>, Judge Advocate<\/strong> (10 USC 1044a), or a foreign Consul diplomatic official registered with the State Department Office of Protocol, the document must be authenticated by an apostille<\/strong> or authentication certificate<\/strong> from the U.S. State Department Office of Authentications<\/a><\/strong><\/span>.<\/p>\n

Documents notarized by a state notary and authenticated by an SOS office do not require further authentication from the U.S. State Department.<\/p>\n

<\/span>Hague Convention Non-Member Authentication<\/span><\/h2>\n

For countries that are not members of the Hague Convention, after authentication by state or federal officials in the U.S., then the document must be authenticated by a foreign consulate or embassy before use in the destination country. Check the embassy website for the country for more information.<\/p>\n

<\/span>Verify an Apostille or Authentication<\/span><\/h2>\n

If you receive a document authenticated by the Colorado SOS, you can verify it by using the SOS website at https:\/\/www.sos.state.co.us\/auth\/VerifyApostilleSearch.do<\/a><\/span> \u00a0Enter the authentication\u00a0number and issue date. \u00a0Here is a sample verification<\/strong>:<\/p>\n

<\/span>Certificate of Fact<\/span><\/h2>\n

Note:\u00a0 For documents going to Puerto Rico<\/strong>, or other US territories<\/a><\/strong><\/span>, the SOS does not issue an apostille, since the destination is not a foreign country.\u00a0 Only countries can sign treaties, such as the Hague Treaty.<\/p>\n

On written request, the SOS can issue a Certificate of Fact<\/strong> that confirms that the named notary is or was valid and in good standing in Colorado from start date to end date.\u00a0 This is a stand-alone document.\u00a0 No notarized document is needed.\u00a0 It does not certify the correctness or authenticity of any notarization by the notary.<\/p>\n

The SOS website allows the public to look up the history and commission status for any Colorado notary by notary name or notary ID number and view or print a computer-generated, time-stamped Certificate of Fact<\/strong>, with a confirmation number, at no cost, at\u00a0Verify Colorado Notary<\/strong><\/span>.<\/a><\/p>\n

<\/span>Foreign Language Documents<\/span><\/h2>\n

The document may be in a foreign language<\/strong><\/a><\/span>, but the notary certificate must be in English<\/strong>.\u00a0 The notary must be able to communicate with the document signer directly, without using a translator<\/strong>.<\/p>\n
