<strong>jurat<\/strong> attached:<\/p>\n<ol>\n<li style=\"text-align: justify;\">the <strong>notary<\/strong> may place the signer under oath or affirmation,<\/li>\n<li style=\"text-align: justify;\">may ask for signer\u2019s approval to line through the <strong>acknowledgment<\/strong> and replace it with <strong>jurat<\/strong> wording, or<\/li>\n<li style=\"text-align: justify;\">may request written instructions if the signer requires an acknowledgment, or<\/li>\n<li style=\"text-align: justify;\">may decline to notarize the document if it contains an acknowledgment.<\/li>\n<\/ol>\n<p style=\"text-align: justify;\">If the affidavit contains a <strong>split jurat certificate<\/strong>, with the <strong>venue<\/strong>\u00a0(state and county) at the top, the <strong>notary<\/strong> completes the <strong>venue<\/strong> and any <strong>preamble<\/strong> or introductory statement regarding the signer being duly sworn, including the signer\u2019s name.<!--more--><b><br \/>\n<\/b><\/p>\n<h2 style=\"text-align: justify;\"><span class=\"ez-toc-section\" id=\"Citations_Regarding_Notarizing_an_Affidavit\"><\/span><span id=\"Citations_Regarding_Notarizing_an_Affidavit\"><b>Citations Regarding Notarizing an Affidavit<\/b><\/span><span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p style=\"text-align: justify;\"><img decoding=\"async\"  class=\"alignleft size-full wp-image-2447\" src=\"data:image\/gif,GIF89a%01%00%01%00%80%00%00%00%00%00%FF%FF%FF%21%F9%04%01%00%00%00%00%2C%00%00%00%00%01%00%01%00%00%02%01D%00%3B\" data-layzr=\"https:\/\/abclegaldocs.com\/blog-Colorado-Notary\/wp-content\/uploads\/gavel-200x200.jpg\" alt=\"gavel 200x200\" width=\"200\" height=\"200\" \/>Listed below are some <strong>citations<\/strong> from <strong>Colorado<\/strong> and other states regarding the proper notary procedure for notarizing an affidavit.<\/p>\n<p style=\"text-align: justify;\">1.\u00a0 Where an affidavit is called for, an <strong>acknowledgment<\/strong> will not suffice.\u201d (<i><b>Pina v. Simon-Pina<\/b><\/i> 544 So. 2d 1161)<\/p>\n<p style=\"text-align: justify;\">2.\u00a0 Archie\u2019s [**3] motion merely contains a certificate by a notary public that \u201cthe foregoing instrument was acknowledged before me this 22nd day of March\u00a01994, by Antonio Archie, who is personally known to his attorney and who did take an <strong>oath<\/strong>.\u201d An \u201c<strong>acknowledgment<\/strong>,\u201d even under oath, is nothing more than a confirmation by Archie that the <strong>signature<\/strong> is genuine. It is not equivalent to swearing under oath that the facts alleged are true and correct.\u201d (<i><b>Archie v. State<\/b><\/i> 660 So. 2d 348)<\/p>\n<p style=\"text-align: justify;\">3.\u00a0 The notary public may not take an <strong>acknowledgment<\/strong> of execution in lieu of an oath\u00a0if an oath is required. (<b><i>Florida Statute F.S. 117.03<\/i><\/b><b><i>, Administration of Oaths<\/i><\/b>)<\/p>\n<p style=\"text-align: justify;\">4.\u00a0 An affidavit without a <strong>notary\u2019s seal<\/strong> is not properly notarized and therefore, is <strong>defective<\/strong>. <i><b>Venable v.<\/b><\/i> State, 113 S.W.3d 797, 800 (Tex. App.- Beaumont 2003, pet. ref\u2019d)<\/p>\n<p style=\"text-align: justify;\">5.\u00a0 A valid affidavit must include \u201ca certificate by a competent officer that the writing was sworn to by the person who signed it,\u201d known as a <strong>jurat<\/strong>.\u00a0 <i><b>Acme Brick v. Temple Associates, Inc.<\/b><\/i>, 816 S.W. 2d 440, 441 (Tex. App \u2013 Waco 1991, writ denied)<\/p>\n<p style=\"text-align: justify;\">6.\u00a0 A document bearing a simple \u201c<strong>acknowledgment<\/strong>\u201d is not an <strong>affidavit<\/strong>.\u00a0 An acknowledgment is merely an admission that the parties signed the document in question, and does not prove the document contains true and correct <i>Id. <\/i>factual statements.\u00a0\u00a0 <i><b>Perkins v. Crittendon<\/b>, <\/i>462 S.W. 2d at 567-568.<\/p>\n<p style=\"text-align: justify;\">7.\u00a0 A document bearing a notary\u2019s attestation that \u201ccertifies\u201d that the person who signed the document stated that it is true and correct is <strong>defective<\/strong> because it lacks the requisite swearing or affirmation.\u00a0 <i><b>State v.<\/b><\/i> LeBlanc, Inc.,\u00a0 399 S.W. 2d 919, 922 (Tex. Civ. App. \u2013 Houston 1966, no writ)<\/p>\n<p style=\"text-align: justify;\">8.\u00a0 Notary failed to verify identity and failed to place expert witness under <strong>oath<\/strong> for a <strong>jurat<\/strong> on an <strong>affidavit<\/strong> of merit for a medical malpractice lawsuit.\u00a0 Affidavit was <strong>rejected<\/strong> by Court of Appeals as being <strong>defective<\/strong> and not considered an affidavit at all because it contained a false jurat and was not properly notarized.\u00a0 <i><b>Glancy v Steinberg<\/b>, 2003 WL 21465239 N.W.2d-MI<\/i><\/p>\n<p style=\"text-align: justify;\">9.\u00a0 Colorado Supreme Court ruled that a <strong>petition<\/strong> that was circulated for signatures was invalid because it contained a <strong>defective<\/strong> affidavit, lacking the required wording that the circulator has \u201cread and understands the laws governing the circulation of petitions\u201d.\u00a0 <i><b>Loonan v.<\/b><\/i> Woodley, 882 P.2d 1380 (Colo. 1994)<\/p>\n<h2 style=\"text-align: justify;\"><span class=\"ez-toc-section\" id=\"Colorado_Law_for_Notarizing_an_Affidavit\"><\/span>Colorado Law for Notarizing an Affidavit<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p style=\"text-align: justify;\">10.\u00a0 <b>CRS 12-55-110 (1)<\/b> Every notary public is empowered to:<br \/>\n<b>(a)<\/b> Take acknowledgments and other unsworn statements<br \/>\n<b>(d)<\/b> Take depositions, <strong>affidavits<\/strong>, verifications, and other sworn testimony or statements.<\/p>\n<p style=\"text-align: justify;\">11.\u00a0 <b>CRS 12-55-119<\/b> If an oath or affirmation is administered by a notary in writing, a <strong>jurat<\/strong> certificate must be used, stating that the statements were made before the notary, under <strong>oath<\/strong> or <strong>affirmation<\/strong>.<\/p>\n<p style=\"text-align: justify;\">12.\u00a0 <b>CRS 12-55-207<\/b> An <strong>acknowledgment<\/strong> certificate indicates that the signer appeared before the notary, acknowledged their signature, and executed the instrument for the purposes therein stated. \u00a0(No sworn statement is made before the notary.)<\/p>\n<p style=\"text-align: justify;\">13.\u00a0 <b>CRS 18-8-503<\/b>. <strong>Perjury<\/strong> in the second degree.<br \/>\n<b>(1)<\/b> A person commits <strong>perjury<\/strong> in the second degree if, other than in an official proceeding, with an intent to mislead a public servant in the performance of his duty, he makes a materially false statement, which he does not believe to be true, under an <strong>oath<\/strong> required or authorized by law.<br \/>\n<b>(2)<\/b> Perjury in the second degree is a class 1 misdemeanor.<\/p>\n<p style=\"text-align: justify;\">14.\u00a0 To make a valid oath, for the falsity of which perjury will lie, there must be in some form, in the presence of an officer authorized to administer it, an unequivocal and present act by which the <strong>affiant<\/strong> consciously takes upon himself the obligation of an <strong>oath<\/strong>. <i><b>Rogers v. People<\/b><\/i>, 161 Colo. 317, 422 P.2d 377 (1966).<\/p>\n<p style=\"text-align: justify;\">15.\u00a0 No presumption of oath-taking is held to apply where the notary\u2019s testimony was equivocal on the issue of whether the <strong>oath<\/strong> was taken.\u00a0<i><b>Rogers v. People<\/b><\/i>, 161 Colo. 317, 422 P.2d 377 (1966). [<strong>perjury<\/strong> conviction overturned where notary probably did not administer oath]<\/p>\n<h2 style=\"text-align: justify;\"><span class=\"ez-toc-section\" id=\"Colorado_Secretary_of_State_Affidavit_Definition\"><\/span>Colorado Secretary of State Affidavit Definition<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p style=\"text-align: justify;\">16.<b>\u00a0 Colorado Notary Law Monograph<\/b>, Michael L. Shea, JD, pg 10, <b>Notarial Duties<\/b>: Based on <i><b>Rogers v. People<\/b> (1966), <\/i>the Colorado Supreme Court expects a notary to administer an <strong>oath<\/strong> or <strong>affirmation<\/strong> where the principal \u201cswears\u201d to the truthfulness of the statement.<\/p>\n<p style=\"text-align: justify;\">17.<b>\u00a0 Colorado Notary Handbook, Definitions:<br \/>\nAffidavit<\/b>\u2013 A written declaration made under <strong>oath<\/strong> or <strong>affirmation<\/strong> before a notary public or other authorized officer, in which the signer swears or affirms that the statements or declarations in the document are true.<\/p>\n<h2 style=\"text-align: justify;\"><span class=\"ez-toc-section\" id=\"Colorado_Notary_Law_Primer\"><\/span>Colorado Notary Law Primer<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p style=\"text-align: justify;\">18. <b>Colorado Notary Law Primer<\/b>, 3rd ed., <strong>National Notary Association (NNA)<\/strong><\/p>\n<p style=\"text-align: justify;\" align=\"LEFT\">pg. 29, <b>Depositions and Affidavits<\/b>: An affidavit is a signed statement made under <strong>oath<\/strong> or <strong>affirmation<\/strong> by a person called an <strong>affiant<\/strong>, and it is used for a variety of purposes, both in and out of court. For both a deposition and an affidavit, the Notary must administer an oath or affirmation and complete some form of <strong>jurat<\/strong>, which the Notary signs and seals.<\/p>\n<p style=\"text-align: justify;\" align=\"LEFT\">pg. 30,\u00a0 In an <b>affidavit<\/b>, the Notary\u2019s certificate typically sandwiches the affiant\u2019s signed statement, with the <strong>venue<\/strong> and affiant\u2019s name at the top of the document and the <strong>jurat<\/strong> wording at the end.\u00a0 The Notary is responsible for the <strong>venue<\/strong>, affiant\u2019s name, and any notarial text at the beginning and end of the affidavit. The <strong>affiant<\/strong> is responsible for the signed statement in the middle.<\/p>\n<p style=\"text-align: justify;\" align=\"LEFT\">pg. 30,\u00a0 Depositions and affidavits require <strong>jurat<\/strong> certificates.<\/p>\n<p style=\"text-align: justify;\">pg. 31,\u00a0 A <strong>jurat<\/strong> requires the principal to take an oath or affirmation.<\/p>\n<h2 style=\"text-align: justify;\"><span class=\"ez-toc-section\" id=\"Colorado_Rules_of_Civil_Procedure\"><\/span>Colorado Rules of Civil Procedure<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p style=\"text-align: justify;\">19.\u00a0 <b><i>Colorado Rules of Civil Procedure (CRCP) Rule 108<br \/>\n<\/i><\/b><b>Affidavits<\/b>\u2013 An <strong>affidavit<\/strong> may be sworn to either within or without this state before any officer authorized by law to take and certify the acknowledgment of deeds conveying lands.\u00a0\u00a0<b><i><br \/>\n<\/i><\/b>Cross references: For officers authorized to take acknowledgments of deeds, see \u00a7 24-12-104, 24-12-105, and 38-30-126 to 38-30-135, C.R.S.<\/p>\n<p style=\"text-align: justify;\">20.\u00a0 <b><i>Colorado Rules of Civil Procedure (CRCP) Rule 110<br \/>\nMiscellaneous-<\/i><\/b> (a) Amendments. No writ or process shall be quashed, nor any order or decree set aside, nor any undertaking be held invalid, nor any <b>affidavit<\/b>, traverse, or other paper be held insufficient if the same is corrected within the time and manner prescribed by the court, which shall be liberal in permitting amendments.<\/p>\n<h2 style=\"text-align: justify;\"><span class=\"ez-toc-section\" id=\"Dictionary_Definition_of_Affidavit\"><\/span>Dictionary Definition of Affidavit<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p style=\"text-align: justify;\">21.<b> Black\u2019s Law Dictionary: Affidavit<\/b>\u2013 a written or printed declaration or statement of facts, made voluntarily and confirmed by the <strong>oath<\/strong> or <strong>affirmation<\/strong> of the party making it, taken before an officer having authority to administer such oath.<\/p>\n<p style=\"text-align: justify;\">22.\u00a0 <b>Merriam-Webster Dictionary:<br \/>\nAffidavit<\/b>\u2013 a sworn statement in writing made especially under <strong>oath<\/strong> or an <strong>affirmation<\/strong> before an authorized magistrate or officer.
