And all laws and parts of laws for punishing <strong>perjury<\/strong>, or <strong>subordination of perjury<\/strong>, committed in any such <strong>oaths<\/strong> or <strong>affirmation<\/strong>, when taken or made before any such <strong>justice of the peace<\/strong>, shall apply to any such offence committed\u00a0in any oaths or affirmations which may be taken under this act before a <strong>notary public<\/strong>, or <strong>commissioner<\/strong>, as hereinafter named:<\/p>\n<p style=\"text-align: justify;\"><em>Provided always<\/em> That on any <strong>trial<\/strong> for either of these offences, the <strong>seal<\/strong> and <strong>signature<\/strong> of the <strong>notary<\/strong> shall not be deemed sufficient in themselves to establish the official character of such <strong>notary<\/strong>, but the same shall be shown by other and proper <strong>evidence<\/strong>.<!--more--><\/p>\n<p style=\"text-align: justify;\">Sec. 2. <em>And be it further enacted<\/em>, That all the powers and authority conferred in and by the preceding section of this act upon <strong>notaries public<\/strong> be, and the same are hereby, vested in, and may be exercised by, any <strong>commissioner<\/strong> appointed, or hereafter to be appointed, by any <strong>Circuit Court<\/strong> of the United States, under any act of Congress authorizing the appointment of commissioners to take <strong>bail<\/strong>, <strong>affidavits<\/strong>, or <strong>depositions<\/strong>, in causes pending in the <strong>courts<\/strong> of the United States.\u201d<br \/>\nApproved, September 16, 1850.<\/p>\n<p style=\"text-align: justify;\">Zachary Taylor, President until his death July 9, 1850. It only refers to oaths, affirmations, or acknowledgments.<\/p>\n<h2 style=\"text-align: justify;\"><span class=\"ez-toc-section\" id=\"Williams_v_Ten_Eyck_1886_DC_Supreme_Court\"><\/span>Williams v. Ten Eyck, 1886, DC Supreme Court<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p style=\"text-align: justify;\">Note: This case involved an\u00a0acknowledgment of a <strong>deed<\/strong> acknowledged and notarized under the notaries public act of 1850 before the law changed in 1871.<\/p>\n<p style=\"text-align: justify;\">The prior law of April 30, 1838, (5 Statutes, 226), required the <strong>seal<\/strong> of the <strong>justice of the peace<\/strong> to be supported by a certificate of the <strong>clerk<\/strong> under his <strong>seal<\/strong>\u00a0because the justice of the peace had no seal to authenticate his own official acts.<\/p>\n<p style=\"text-align: justify;\">A <strong>notary public<\/strong> has a seal, so no supporting document is required for transactions as evidence to verify a notary&#8217;s official capacity, but is required in the proviso for a trial for perjury.<\/p>\n<p style=\"text-align: justify;\">Under the general <strong>commercial law<\/strong> of the world, the certificate of a\u00a0notary and his seal prove themselves. He is an officer known to the <strong>commercial law<\/strong>, to the <strong>admiralty<\/strong>, and to the <strong>civil law<\/strong>; and wherever he has executed an instrument appropriate to his functions, his seal is recognized, and judicially taken notice of by the courts, and proves itself.<\/p>\n<p style=\"text-align: justify;\">The law changed in February 1871, adding a new provision for <strong>acknowledgments<\/strong> that required <strong>authentication<\/strong> of the notary by the proper officer of the notary&#8217;s state.<\/p>\n<p style=\"text-align: justify;\">Source:\u00a0District of Columbia Supreme Court Case Reports, 1887, Franklin Mackey, page 168<\/p>\n<h2 style=\"text-align: justify;\"><span class=\"ez-toc-section\" id=\"Law_Library_of_Congress\"><\/span>Law Library of Congress<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p style=\"text-align: justify;\">Books on the law formed a major part of the holdings of the <strong>Library of Congress<\/strong> from its beginning.
