(1) Every notary public is empowered to:<br \/>\n(c) Give <strong>certificates<\/strong> or other statements as to a <strong>notarial act<\/strong>\u00a0performed by such notary. Such acts shall include, but are not limited\u00a0to, the giving of certificates as to, or <strong>certified copies<\/strong> of, any <strong>record<\/strong> or\u00a0other <strong>document<\/strong> relating to a <strong>notarial act<\/strong> performed by such notary\u00a0and<br \/>\ncertifying that a copy of a document is a <strong>true copy<\/strong> of another\u00a0document or that a facsimile is a <strong>true facsimile<\/strong> of another document\u00a0in accordance with section 12-55-120.<\/p>\n<p style=\"text-align: justify;\">CRS 12-55-111. <strong>Journal<\/strong>. (1) Every notary public shall keep a <strong>journal<\/strong> of\u00a0every <strong>notarial act<\/strong> of the notary and, <strong>if required<\/strong>, give a <strong>certified copy<\/strong>\u00a0of or a <strong>certificate<\/strong> as to any such <strong>journal<\/strong> or any of the <strong>notary&#8217;s acts<\/strong>,\u00a0upon <strong>payment<\/strong> of the notary&#8217;s fee.<\/p>\n<p style=\"text-align: justify;\"><!--more--><\/p>\n<h2 style=\"text-align: justify;\"><span class=\"ez-toc-section\" id=\"Maintaining_Privacy_of_Notary_Records\"><\/span>Maintaining\u00a0Privacy of Notary Records<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p style=\"text-align: justify;\"><a href=\"https:\/\/www.abclegaldocs.com\/blog-Colorado-Notary\/wp-content\/uploads\/Certificate-of-Notary-Record.jpg\"><img decoding=\"async\"  class=\"alignleft size-full wp-image-4193\" src=\"data:image\/gif,GIF89a%01%00%01%00%80%00%00%00%00%00%FF%FF%FF%21%F9%04%01%00%00%00%00%2C%00%00%00%00%01%00%01%00%00%02%01D%00%3B\" data-layzr=\"https:\/\/abclegaldocs.com\/blog-Colorado-Notary\/wp-content\/uploads\/Certificate-of-Notary-Record.jpg\" alt=\"Certificate of Notary Record\" width=\"200\" height=\"128\" \/><\/a>A notary should maintain the <strong>privacy<\/strong> of customer transactions in notary records. But, the law says a notary shall, <em><strong>if required<\/strong><\/em>, give a certified copy or a certificate of notary record of a <strong>notary act<\/strong>.<\/p>\n<p style=\"text-align: justify;\">The law does not define \u201c<em>required<\/em>.\u201d It is likely this means when required by law\u00a0under a <strong>court\u00a0order<\/strong>, or <strong>subpoena<\/strong>, or to aid <strong>law enforcement<\/strong> in an investigation.<\/p>\n<p style=\"text-align: justify;\">Notary journals are <strong>private<\/strong> and the public at large should not view journal entries. When asking a customer to sign the <span style=\"text-decoration: underline;\"><a href=\"https:\/\/www.abclegaldocs.com\/blog-Colorado-Notary\/notary-journal-comparison\/\" target=\"_blank\" rel=\"noopener noreferrer\"><strong>notary journal<\/strong><\/a><\/span>, previous journal entries should be covered to prevent unauthorized viewing of <strong>confidential information<\/strong>.<\/p>\n<p style=\"text-align: justify;\">When making a <strong>certified copy<\/strong> of a single journal entry, cover up the other entries. Describe the volume and page number where the entry was found.<\/p>\n<p style=\"text-align: justify;\">It is reasonable to accommodate a request for a certificate of notary record from the principal or signer of a transaction, or their authorized agent. But, it is not reasonable to accommodate a request from a snooping family member, friend, neighbor or another party, who\u00a0is not a\u00a0party\u00a0to the transaction.<\/p>\n<p style=\"text-align: justify;\">In some cases, such as\u00a0administering an oath of office, or an oath for witness testimony, there may not be a corresponding signed document.<\/p>\n<p style=\"text-align: justify;\">Situations, where a notary act could not be completed for some reason, should also be entered in the notary journal. The\u00a0certificate of notary record might say &#8220;<em>unable to notarize power of attorney for John Doe due to lack of proper identification<\/em>&#8220;.<\/p>\n<p style=\"text-align: justify;\">The notary journal should be kept <strong>secure<\/strong> and out of view when not in use. Do not leave a notary journal on a counter or desktop where other people might look at it, copy it, take a photograph, or steal it.<\/p>\n<p style=\"text-align: justify;\">CRS 12-55-118 <strong>Unlawfully possessing<\/strong> and using a notary&#8217;s journal or any papers, copies, or electronic records relating to\u00a0notarial acts is a class 3 <strong>misdemeanor<\/strong>.<\/p>\n<p style=\"text-align: justify;\">If an <strong>electronic notary journal<\/strong> is used, adequate security is required to prevent unauthorized access. The electronic journal should be stored using <strong>encryption<\/strong> and only the notary should have the <strong>password<\/strong> to the account.<\/p>\n<h2 style=\"text-align: justify;\"><span class=\"ez-toc-section\" id=\"Historic_Records\"><\/span>Historic Records<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p style=\"text-align: justify;\">Old notary journals are a valuable source of historic records. Contents of old notary records have been published or made available to researchers. The colonial notary journal of <span style=\"text-decoration: underline;\"><a href=\"https:\/\/www.abclegaldocs.com\/blog-Colorado-Notary\/aspinwall-notarial-records-boston-1644\/\" target=\"_blank\" rel=\"noopener noreferrer\"><strong>William Aspinwall<\/strong><\/a><\/span> of Boston in 1644 includes some transactions of the <strong>Pilgrim<\/strong> passengers from the <strong>Mayflower<\/strong>. Notary records of <strong>Spanish explorers<\/strong> and Conquistadors from the landing of <span style=\"text-decoration: underline;\"><a href=\"https:\/\/www.abclegaldocs.com\/blog-Colorado-Notary\/notary-with-christopher-columbus\/\" target=\"_blank\" rel=\"noopener noreferrer\"><strong>Columbus<\/strong><\/a><\/span> provide a wealth of information on that era of discovery.<\/p>\n<h2 style=\"text-align: justify;\"><span class=\"ez-toc-section\" id=\"Constitutional_Right_to_Privacy\"><\/span>Constitutional Right to Privacy<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p style=\"text-align: justify;\">The U. S. Constitution does not contain any explicit <strong>right to privacy<\/strong>. But, the Supreme Court has said that several of amendments in the <span style=\"text-decoration: underline;\"><a href=\"https:\/\/www.abclegaldocs.com\/blog-Colorado-Notary\/u-s-constitution-bill-of-rights\/\" target=\"_blank\" rel=\"noopener noreferrer\"><strong>Bill of Rights<\/strong><\/a><\/span> create the right to privacy.
