According to the <span style=\"text-decoration: underline;\"><strong><a href=\"https:\/\/www.nad.org\/\" target=\"_blank\" rel=\"noopener noreferrer\">National Association of the Deaf (NAD)<\/a><\/strong><\/span> website, the words deaf and hard of hearing (HOH) are preferred. The previously used phrase <strong>hearing impaired<\/strong> is now viewed negatively by many people.\u00a0 The word <strong>Deaf<\/strong>, with a capital D, implies a person who understands <strong>American Sign Language<\/strong> (<strong>ASL<\/strong>).<\/p>\n<p style=\"text-align: justify;\">Most organizations of the deaf use the term \u201cdeaf and hard of hearing.\u201d\u00a0\u00a0Show respect for people by refusing to use outdated or offensive terms. When in doubt, ask the person how they identify themselves.<\/p>\n<p style=\"text-align: justify;\">Only\u00a0a few states have passed laws\u00a0establishing guidelines for providing notary services for <strong>disabled\u00a0<\/strong>persons. The subject may not be included in <strong>notary training<\/strong> classes. So, the notary may not know what procedure to follow. A few states describe procedures for notarizing for a <strong>blind<\/strong> signer, such as reading the document aloud. No states describe procedures for notarizing for a <strong>deaf<\/strong> signer.<\/p>\n<p style=\"text-align: justify;\"><!--more--><\/p>\n<h2 style=\"text-align: justify;\"><span class=\"ez-toc-section\" id=\"Accommodation_of_Physical_Disabilities\"><\/span><img decoding=\"async\"  class=\"alignleft size-full wp-image-5027\" src=\"data:image\/gif,GIF89a%01%00%01%00%80%00%00%00%00%00%FF%FF%FF%21%F9%04%01%00%00%00%00%2C%00%00%00%00%01%00%01%00%00%02%01D%00%3B\" data-layzr=\"https:\/\/abclegaldocs.com\/blog-Colorado-Notary\/wp-content\/uploads\/American-Sign-Language-alphabet-200x355.jpg\" alt=\"American Sign Language alphabet\" width=\"200\" height=\"355\" \/>Accommodation of Physical Disabilities<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p style=\"text-align: justify;\">Colorado notary law CRS 12-55-110.5, Accommodation of Physical Disabilities, states:<\/p>\n<p style=\"text-align: justify;\"><em>A notary public may use <strong>signals<\/strong> or electronic or mechanical means to take an acknowledgment from, administer an oath or affirmation to, or otherwise communicate with any individual in the presence of such notary public when it appears that such individual is unable to communicate <strong>verbally<\/strong> or in <strong>writing<\/strong>.<\/em><\/p>\n<p style=\"text-align: justify;\">So, if a deaf person is not able to communicate verbally or in writing, a notary may use signals, such as <strong>sign language<\/strong>, to communicate. The notary must know sign language and cannot use a <strong>sign language interpreter<\/strong>.<\/p>\n<p style=\"text-align: justify;\">When administering a notary ceremony,\u00a0<strong>oath<\/strong> or <strong>affirmation<\/strong> for witness testimony or an <strong>oath of office<\/strong> to a deaf person, it is recommended to write the wording, oath or affirmation on paper and have it signed and notarized.<\/p>\n<p style=\"text-align: justify;\">Make a note in the notary journal entry about any auxiliary aids, services, sign language interpreter or other accommodations made to serve a person with a disability.<\/p>\n<h2 style=\"text-align: justify;\"><span class=\"ez-toc-section\" id=\"Deaf_or_Hard_of_Hearing_Demographics\"><\/span>Deaf or Hard of Hearing Demographics<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p style=\"text-align: justify;\">About 8.6% of the US population is deaf or hard of hearing, deaf 0.9%, hard of hearing 7.7%<br \/>\nCauses of deafness and hearing loss: noise 33.7%; age 28%; infection or injury 17.1%; present\u00a0from birth\u00a04.4%<br \/>\nNoise-induced hearing loss from a noisy work environment is the\u00a0most common occupational injury.<br \/>\nMost hard of hearing people do not\u00a0use sign language or <strong>lip reading<\/strong>.<br \/>\nAge-related hearing loss often begins around age\u00a045-50, 55% of people over 60 are deaf or hard\u00a0of hearing.<br \/>\nThe <strong>hearing aid<\/strong> is the second most widely used\u00a0assistive technology equipment, after the walking\u00a0cane. More than 70% of hearing aid users are over\u00a064.<\/p>\n<h2 style=\"text-align: justify;\"><span class=\"ez-toc-section\" id=\"Americans_with_Disabilities_Act_ADA\"><\/span>Americans with Disabilities Act (ADA)<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p style=\"text-align: justify;\">Title II of the\u00a0<strong>Americans with Disabilities Act<\/strong> (<strong>ADA<\/strong>) of 1990 covers discrimination by state and local\u00a0<strong>government<\/strong> programs, services and activities. For example, the government must provide a means of <strong>effective communication<\/strong>, such as a <strong>sign language interpreter<\/strong>, if needed by a signing deaf person, whether a citizen or an employee.<\/p>\n<p style=\"text-align: justify;\">Title III of ADA requires businesses (for profit and non-profit) that are <span style=\"text-decoration: underline;\"><a href=\"https:\/\/www.abclegaldocs.com\/blog-Colorado-Notary\/discrimination-in-places-of-public-accommodation\/\" target=\"_blank\" rel=\"noopener noreferrer\"><strong>places of public accommodation<\/strong><\/a><\/span> to provide equal opportunity using effective communication to access services and\u00a0prohibits <strong>discrimination<\/strong> against persons\u00a0with <strong>disabilities<\/strong>.<\/p>\n<p style=\"text-align: justify;\">Definition: A person is &#8220;<strong>disabled<\/strong>&#8221; if he or she has &#8220;a physical or\u00a0mental <strong>impairment<\/strong> that substantially limits one or more of the\u00a0<strong>major life activities<\/strong> of such individual; has a record of such an\u00a0impairment; or is regarded as having such an\u00a0impairment. Major life activities include walking, seeing, <strong>hearing<\/strong>, speaking and several other activities.<\/p>\n<h2 style=\"text-align: justify;\"><span class=\"ez-toc-section\" id=\"Auxiliary_Aids\"><\/span>Auxiliary Aids<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p style=\"text-align: justify;\"><strong>Auxiliary aids<\/strong>\u00a0and services are accommodations used to provide effective communication with people who are deaf or hard of hearing.\u00a0They include, but are not limited to, the use of:<\/p>\n<p><img decoding=\"async\"  class=\"alignleft size-full wp-image-5026\" src=\"data:image\/gif,GIF89a%01%00%01%00%80%00%00%00%00%00%FF%FF%FF%21%F9%04%01%00%00%00%00%2C%00%00%00%00%01%00%01%00%00%02%01D%00%3B\" data-layzr=\"https:\/\/abclegaldocs.com\/blog-Colorado-Notary\/wp-content\/uploads\/VRS-video-interpreter-sign-120x140.jpg\" alt=\"VRS video interpreter sign\" width=\"120\" height=\"140\" \/><strong>gestures<\/strong> or <strong>visual aids<\/strong> to supplement oral\u00a0communication;<br \/>\nuse of a <strong>Qualified Interpreter<\/strong>;<br \/>\nuse of a notepad and pen or pencil to\u00a0exchange <strong>written notes<\/strong>;<br \/>\nuse of a <strong>computer<\/strong> or typewriter;<br \/>\nuse of an assistive listening system\u00a0or device to amplify sound; or<br \/>\nuse of a teletypewriter (TTY), or videophone (video relay service\u00a0or <strong>VRS<\/strong>).<\/p>\n<p style=\"text-align: justify;\">Auxiliary aids and services must be provided unless the entity can demonstrate that doing so would fundamentally alter the nature of the service, or would constitute an <strong>undue burden<\/strong> (significant difficulty or expense).\u00a0Undue burden is measured by the overall financial impact on the whole entity, not based on a single transaction. No <strong>surcharge<\/strong> is allowed for the expense of providing auxiliary aids, services or accommodations.<\/p>\n<h2 style=\"text-align: justify;\"><span class=\"ez-toc-section\" id=\"Disabled_Access_Tax_Credit_for_Business\"><\/span>Disabled Access Tax Credit for Business<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p style=\"text-align: justify;\">Small businesses that earned $1 million or less or had no more than 30 full time employees in the previous year may claim a <strong>tax credit<\/strong> up to $5,000 annually on <span style=\"text-decoration: underline;\"><strong><a href=\"https:\/\/www.irs.gov\/pub\/irs-pdf\/f8826.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">Form 8826, Disabled Access Credit<\/a><\/strong><\/span> for 50% of eligible access expenditures paid over $250 to comply with ADA requirements, including auxiliary aids and sign language interpreters.<\/p>\n<h2 style=\"text-align: justify;\"><span class=\"ez-toc-section\" id=\"Deaf_or_Hard_of_Hearing_Definition\"><\/span>Deaf or Hard of Hearing Definition<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p style=\"text-align: justify;\">Definition: Colorado CRS 13-90-202(6) <strong>Deaf or Hard of Hearing<\/strong>&#8211;\u00a0means a person who has a functional hearing loss of sufficient severity to prevent aural comprehension, even with the assistance of hearing aids.<\/p>\n<h2 style=\"text-align: justify;\"><span class=\"ez-toc-section\" id=\"Effective_Communication_Definition\"><\/span>Effective Communication Definition<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p style=\"text-align: justify;\">Definition: CRS 13-90-202(7)\u00a0<strong>Effective communication<\/strong>&#8211; means those methods of communication that are individualized and culturally appropriate to a person who is deaf or hard of hearing so that he or she can easily understand all auditory information.<\/p>\n<h2 style=\"text-align: justify;\"><span class=\"ez-toc-section\" id=\"Qualified_Interpreter_Definition\"><\/span>Qualified Interpreter Definition<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p style=\"text-align: justify;\"><img decoding=\"async\"  class=\"alignleft size-full wp-image-5028\" src=\"data:image\/gif,GIF89a%01%00%01%00%80%00%00%00%00%00%FF%FF%FF%21%F9%04%01%00%00%00%00%2C%00%00%00%00%01%00%01%00%00%02%01D%00%3B\" data-layzr=\"https:\/\/abclegaldocs.com\/blog-Colorado-Notary\/wp-content\/uploads\/sign-language-interpreter-80x80.jpg\" alt=\"sign language interpreter\" width=\"80\" height=\"80\" \/><\/p>\n<p style=\"text-align: justify;\">Definition: CRS 13-90-202(8) <strong>Qualified Interpreter<\/strong>&#8211; means a person who has a valid <strong>certification of competency<\/strong> accepted by the <strong>Colorado Commission for the Deaf and Hard of Hearing<\/strong> (<strong>CCDHH<\/strong>) and includes, but is not limited to, oral interpreters, sign language interpreters, and intermediary interpreters.<\/p>\n<h2 style=\"text-align: justify;\"><span class=\"ez-toc-section\" id=\"Service_Animals\"><\/span>Service Animals<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p style=\"text-align: justify;\">CRS 24-34-803 <strong>Rights of individuals with service animals<\/strong>&#8211;\u00a0A qualified individual with a disability has the right to be accompanied by a <strong>service animal<\/strong> individually trained for that individual without being required to pay an extra charge for the service animal.<\/p>\n<h2 style=\"text-align: justify;\"><span class=\"ez-toc-section\" id=\"Pikes_Peak_Public_Library_Deaf_Resources\"><\/span>Pikes Peak Public Library Deaf Resources<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p style=\"text-align: justify;\">Pikes Peak Public Library has several assistive resources available for patrons. Equipment varies by library branch.<\/p>\n<p style=\"text-align: justify;\">Sorenson <strong>Video Relay Service<\/strong> (<strong>VRS<\/strong>): a videophone allows people who are deaf, hard of hearing, or speech-impaired to communicate over high-speed Internet using American Sign Language (ASL). An ASL interpreter relays the phone call verbally to a hearing person. It replaces TTY or Text Telephone.\u00a0VRS is paid for by the government\u2019s Telecommunications Relay Service (TRS) fund.<br \/>\nVRS-equipped laptops.<br \/>\nRoom equipped with a <strong>hearing loop<\/strong> to assist individuals with hearing loss. Switch hearing device to T-Coil setting, or ask for a portable receiver.<br \/>\nASL interpreters are available for library-sponsored programs with at least 7 days advance notice.<\/p>\n<h2 style=\"text-align: justify;\"><span class=\"ez-toc-section\" id=\"Deaf_Signer_Notary_Guide\"><\/span>Deaf Signer Notary Guide<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p style=\"text-align: justify;\">This list of notary related sentences is an <strong>auxiliary aid<\/strong> to help communicate with a deaf or hard of hearing person.
