\"agent's<\/a>Agent\u2019s Certification of Authority of Power of Attorney<\/h1>\n

One of the most common legal forms used is a Power of Attorney<\/strong><\/a><\/span> (POA<\/strong>).\u00a0 This form allows the signer, known as the Principal<\/strong>, to appoint one or more persons to serve as the Principal’s agent<\/strong>, or attorney-in-fact<\/strong>, to act on behalf of the Principal. The agent may sign a notarized Certification of Authority<\/strong> to verify POA status.<\/p>\n

Colorado<\/strong> updated its Power of Attorney laws and adopted the Uniform Power of Attorney Act<\/strong>, effective January 1, 2010.\u00a0 A sample POA form<\/a><\/span><\/strong> and instructions are included in the state statutes.<\/p>\n

The form is used to appoint an agent to have general financial powers<\/strong>, including authority over bank accounts, real property, personal property, stocks, and bonds, operating a business, insurance, estates and trusts, legal claims, personal and family maintenance, government benefit programs, retirement plans, and taxes.<\/p>\n

The form does not authorize the agent to make health care decisions<\/strong> for the Principal.\u00a0 A\u00a0health care<\/strong> or medical\u00a0power of attorney<\/strong><\/a><\/span> can be used for that purpose.<\/p>\n

A Power of Attorney<\/strong> may expire or become invalid<\/strong> for several reasons including the death<\/strong> of the principal, the incapacity<\/strong> of the principal (if it is not a durable<\/strong> power of attorney), revocation<\/strong> of the POA, divorce<\/strong>, an expiration date<\/strong>, completion<\/strong> of the authorized acts, or resignation<\/strong> of the agent<\/strong>.<\/p>\n

Agent’s Certification of Authority<\/h2>\n

To deter fraud<\/strong> and verify<\/strong> that a POA is valid<\/strong>, a certification<\/strong> form, signed by the agent<\/strong> may be used.\u00a0 The agent makes a sworn statement<\/strong>, under penalty of perjury<\/strong>, that the POA is valid, and the agent has the authorization<\/strong> to act on behalf of the principal.\u00a0 Colorado law allows the recipient of a POA to request a certification<\/strong>.<\/p>\n
