\"FTC<\/a>Digital Advertising Disclosure<\/h1>\n

If you receive compensation<\/strong> for affiliate marketing<\/strong> of goods or services or use endorsements<\/strong> or testimonials, you must follow the Federal Trade Commission<\/strong> (FTC)<\/strong> digital advertising disclosure<\/strong> rules.<\/p>\n

You must include an advertising disclosure<\/strong> on every website page or blog post or comment that includes a review, sponsored post, endorsement, recommendation, comment or link that is a promotion<\/strong> for a product or service where you may receive compensation.\u00a0 Compensation<\/strong> is usually monetary, but may also be received in the form of goods or services.<\/del><\/p>\n

<\/span>Product Review Disclosure<\/span><\/h2>\n

For example, you might receive a free<\/strong> product<\/strong> for a product review<\/strong>.\u00a0 You must have an advertising disclosure that you received the free product as compensation for writing the product review.<\/p>\n

<\/span>Disclosure Requirements<\/span><\/h2>\n

The advertising disclosure must be immediately clear and understandable to the reader, in plain language<\/strong>.\u00a0 The reader must be made aware of the compensation relationship.<\/p>\n

The advertising disclosure must be prominent<\/strong>, conspicuous<\/strong>, easy to see, and in close proximity<\/strong> to the product, service or claim being made.\u00a0 Size, color, and graphics affect prominence.\u00a0 An advertising disclosure hidden or hard to find in the footer of a web page, fine print or the terms of use<\/strong> page is not sufficient.\u00a0 As a best practice, place the advertising disclosure as close as possible to the “triggering claim” for the product\/service you are discussing.\u00a0 Design the layout so that web page scrolling<\/strong> is not required to see the disclosure.<\/p>\n

If a media platform does not provide an opportunity to make a clear and conspicuous<\/strong> disclosure, do not use that platform.<\/p>\n

No additional reader action<\/strong> may be required to see the advertising disclosure.\u00a0 No clicking, or hovering over a link may be required.\u00a0 It is not sufficient to have a link that says:\u00a0 Click here<\/strong> to read our affiliate disclosure information.\u00a0 A hyperlink may lead to additional information and should be a different color and underlined.\u00a0 It should have a clear, understandable description of the type of disclosure.<\/p>\n

Pop-up<\/strong> disclosures should not be used since they may be blocked.\u00a0 Disclosures must not require the use of Adobe Flash Player<\/strong>, which may not be displayed on mobile devices.<\/p>\n

Disclosures should be provided before the consumer makes the decision<\/strong> to buy, e.g., before clicking on an \u201corder now\u201d button or a link that says \u201cadd to shopping cart.\u201d\u00a0 For audio<\/strong> claims, use audio disclosures.\u00a0 For written<\/strong> claims, use written disclosures.\u00a0 For video<\/strong> clips, the visual disclosure must be displayed in a legible<\/strong> size, for a sufficient duration<\/strong>, for consumers to notice, read, and understand.<\/p>\n

For tweets on Twitter<\/strong>, the word “Ad:<\/strong>” or “Sponsored:” at the beginning of the tweet should be used to inform consumers of the compensated relationship.<\/p>\n

The ultimate test is not the font size or location of the disclosure, but whether the information is actually conveyed<\/strong> to the consumer.\u00a0 Requiring consumers to click to “agree” to terms does not make a disclosure clear and conspicuous<\/strong>.\u00a0 Website and blog designs should be mobile responsive<\/strong>, so that text size is legible<\/strong> and scrolling<\/strong> is not required.<\/p>\n

<\/span>FTC Advertising Disclosure Guides<\/span><\/h2>\n

FTC Guides Concerning the Use of Endorsements<\/strong> and Testimonials<\/strong> in Advertising<\/strong> (\u201cEndorsement Guides<\/strong>\u201d) apply to \u201cany advertising message . . . that consumers are likely to believe reflects the opinions, beliefs, findings, or experience of a party other than the sponsoring advertiser”.<\/p>\n

The Federal Trade Commission<\/strong> (FTC<\/strong>) has several articles and publications on their website regarding this topic, including, “.com Disclosures, <\/a>How to Make Effective Disclosures in Digital Advertising<\/a>.<\/strong>“<\/p>\n

<\/span>Deceptive Trade Practices<\/span><\/h2>\n

The FTC enforces federal consumer protection<\/strong> laws, regarding “unfair<\/strong> or deceptive<\/strong> acts or practices” in advertising<\/strong>, marketing<\/strong> and sales<\/strong>.\u00a0 The same consumer protection laws that apply to offline media also apply to online media, including mobile devices with small screen displays.<\/p>\n

An ad is deceptive<\/strong> if it contains a statement, or omits information, that is likely to mislead<\/strong> consumers acting reasonably under the circumstances, and is \u201cmaterial\u201d or important to a consumer\u2019s decision to buy or use the product or service.<\/p>\n

If an endorsement<\/strong> is not representative of the performance that consumers can generally expect to achieve with a product, advertisers must disclose the generally expected performance in the depicted circumstances.<\/p>\n

Any solicitation for the purchase of consumer products with a warranty<\/strong> must disclose the text of the warranty offer or how consumers can obtain it for free.<\/p>\n
