\"Colorado<\/a>How to Notarize a Power Of Attorney in Colorado<\/h1>\n

One of the most common legal forms that I am asked to notarize is a Power of Attorney<\/strong> (POA<\/strong>).\u00a0 This form allows the signer, known as the Principal<\/strong>, to appoint one or more persons as an agent<\/strong>, or attorney-in-fact<\/strong>, to act on behalf of the Principal.<\/p>\n

Colorado<\/strong> updated its Power of Attorney laws and adopted the Uniform Power of Attorney Act<\/strong>, (UPOAA), effective January 1, 2010.\u00a0 A sample POA form<\/strong> is included in the state statutes.<\/p>\n

A Colorado POA created after UPOAA is a durable POA<\/strong>, continuing in effect if the principal becomes incapacitated.<\/p>\n

<\/p>\n

The form is used to appoint an agent to have general financial powers<\/strong>, including authority over bank accounts, real property, personal property, stocks, and bonds, operating a business, insurance, estates and trusts, legal claims, personal and family maintenance, government benefit programs, retirement plans, and taxes.<\/p>\n

In addition, there are other optional sections on the form to grant additional specific powers<\/strong>, known as\u00a0hot powers<\/a><\/span>,<\/b>\u00a0and special instructions<\/strong>, and to nominate a conservator<\/strong> or guardian<\/strong>, should a court need to appoint one at a future date.<\/p>\n

The form only requires the signature<\/strong> of the Principal, and an acknowledgment<\/strong> by the Principal made before a Notary Public<\/strong>.\u00a0 The agent does not need to sign the form and no witnesses are required in Colorado.\u00a0 Other states may require the signature of the agent or witnesses.<\/p>\n

The sample statutory form<\/strong> also includes instructions<\/strong> for the agent, to help them understand their role, powers, and duties.\u00a0 The agent must keep a record<\/strong> of the actions performed on behalf of the principal.\u00a0 See our article on keeping an agent record<\/strong><\/a><\/span> for a POA.<\/p>\n

The form does not authorize the agent to make health care decisions<\/strong> for the Principal.\u00a0 A\u00a0health care<\/strong> or medical\u00a0power of attorney<\/strong><\/a><\/span> can be used for that purpose.<\/p>\n
