\"Colorado<\/a>Power of Attorney, Agent Record Book<\/h1>\n

If you are serving as an agent<\/strong> under a Power of Attorney<\/strong> (POA<\/strong>),\u00a0keep an agent record<\/strong> of your actions.\u00a0 In Colorado, the statutory POA provided in the law includes instructions regarding the agent’s duties<\/strong>.<\/p>\n

When you accept the authority\u00a0granted under a POA, you have legal duties that\u00a0continue until you resign, or the POA is terminated or revoked.<\/p>\n

<\/span>Duty of Loyalty<\/span><\/h2>\n

You must act according to the terms of the POA<\/strong>, loyally<\/strong>, in the best\u00a0interest<\/strong> of the principal, and in good faith<\/strong>, using reasonable care<\/strong>, competence, <\/strong>and diligence<\/strong>.\u00a0 You should not exceed the authority granted by the POA and must sign documents in your capacity as the agent or attorney-in-fact for the principal.<\/p>\n

<\/span>Conflict of Interest<\/span><\/h2>\n

You must avoid conflicts of interest<\/strong> that would impair your ability to perform your duties,\u00a0cooperate<\/strong> with any person that has the authority to make health care decisions<\/strong> for the principal, and attempt to\u00a0preserve\u00a0the principal’s estate plan<\/strong>.<\/p>\n

<\/span>Termination<\/span><\/h2>\n

You must follow any\u00a0special instructions<\/strong> in the POA, and stop acting as an agent when your authority terminates<\/strong> due to the death<\/strong> of the principal,\u00a0revocation<\/strong> of the POA, a terminating event<\/strong> stated in the POA, or the purpose of the POA has been fully accomplished<\/strong>.<\/p>\n

If you violate<\/strong> the Uniform Power of Attorney Act (UPOAA)<\/strong>\u00a0or act outside of your\u00a0authority<\/strong> as an agent, you may be held liable<\/strong> for any damages caused by your violation.<\/p>\n

<\/span>Agent Record<\/span><\/h2>\n

Keep an agent record<\/strong> of all receipts, disbursements, and transactions<\/strong> made on behalf of the principal.\u00a0 Keep a record of your phone calls, correspondence, meetings,\u00a0documents processed, travel and actions taken as an agent.<\/p>\n

In\u00a0addition to\u00a0keeping individual records, it is useful to keep an agent record book<\/strong> or log<\/strong> that shows all of your actions, so that you do not forget to perform a duty, and so that another person can see what\u00a0you have done.\u00a0 This can be very useful to show to the principal, or a designated monitor<\/strong>, or to show to a successor agent if you need to resign as the primary agent and let a secondary agent take over.<\/p>\n
